The Role of Human Rights in the Transition to a Low-Carbon Economy in Chile

Abstract

The Inter-American Commission on Human Rights (hereinafter, CIDH) and the Special Rapporteur on Economic, Social, Cultural, and Environmental Rights (hereinafter, REDESCA) made explicit the relationship between the effects of climate change and human rights in their Resolution No. 3/2021 on "Climate Emergency: Scope and Inter-American Human Rights Obligations." From that document, nine duties of the Member States are derived, among which stands out the duty to enact "fiscal, economic, environmental, and social policies for a just transition." In this context, we wonder how the process for a just transition in Chile has developed, aiming to determine whether national fiscal, economic, and social policies enable, facilitate, or hinder the path towards a low-carbon economy in terms of justice and equity.
