Consulta indígena como mecanismo especial de accountability social

Abstract

The Indigenous Consultation is a special participation mechanism to obtain consent in the implementation of legal and/or political decisions that affects indigenous people. It constitutes the basis of ILO Convention 169th, being able to discover a dimension of accountability. This paper´s objecti-ve is to identify elements of accountability in the Indigenous Consultation using two types of analysis categories: those extracted from the conceptual clarifications of accountability, and those concrete and explicit orientations from the particular design of the Indigenous Consultation and its implementation in Chile. The existing categories of social accountability in the current design of the Indigenous Consultation in Chile are presented, distinguishing its potential within social responsibility as a mechanism for citizen participation, using documentary analysis as work methodo-logy. As results, this work proposes an analysis matrix, concluding that the Indigenous Consultation, in order to become an eectively mechanism of social accountability, requires a substantial improvement in normative standards, as well as redesigns, restructuring and articulation with other existing mechanisms. The foregoing notwithstanding to other factors that allow symmetrically, in good faith, an active involvement and effective influence at each stage
