Abstract

The article consists in a study on the case law of the Chilean Council for Transparency regarding the refusal of public access to environmental information. In particular, it identifies the most invoked grounds for refusal during the proceeding before this body, systematizes and investigates the decisions of the Council, especially the grounds related to the proper performance of duties and to the protection of fundamental rights, especially in its aspect related to the protection of commercial or economic rights.
