Abstract

This article researches and presents a thesis about the sense of article 19 N° 8 section 2 of the Constitution. It stands in a different side to what has usually been sustained by the doctrine. This article seeks to protect the right to live in an unpolluted environment, continuing to protect the rights of economical content of the restrictions that might be established by the legislation to protect the environment, matter that negatively affects the effectiveness of the first right. The thesis is founded in the ideology that inspires the regulation of economical activities in the Constitution of 1980, in the role of the law reserve, and lastly, in the effects of the specificity requirements about legislation.
