Abstract

Detailed comments on the children protection services established by the Children (Catalan) Act 2010, and the Second Law of the Civil Code of Catalonia. The passage of these two laws has meant the definitive adaptation of Catalan law guard model introduced by Organic Law 1/1996, of 15 January, on the legal protection of children, differing from its entry into force between risks situations and helplessness. Nevertheless, while recognizing the important progress made in Catalonia in recent years on care and protection of children and adolescents, we cannot make the mistaken belief considering that this has reached a definitive level of substantive and procedural clarity, on the contrary, there is an implicit or latent risk that, if not seriously considered, may soon become our protector system in a model, if anything, even more complicated. Against the background described above, we reckon that the most difficult obstacle to overcome by the Catalan legislator, when establishing the various legal mechanisms for the protection of children and adolescents, has been and continues being to try to reconcile the effective and appropriate attention to the minors with the demands and needs that presented their parents or legal guardians. This paper provides some notes or guidelines that seek to respond adequately some of the dilemmas throughout the implementation process of the present case model.
