Abstract

The problem of mass displacement of large numbers of people within Europe, is not only motivated by the serious economic and social situation in their countries of origin but also in situations of war and political persecution. The traditional right of asylum has become today in m ore than one aspect of migration policy and is thus losing its political and humanitarian. The boundaries between immigration caused by poorly \ za politically motivated and also tend to fade in the European legal space, threatening the right of asylum recognized historically, both in international law and in the constitutional procedure, as a fundamental human right .
