Abstract

This study analyzes the application made by the Supreme Court of the casacional procedure for the liminal rejection of the cassation appeal of art. 782 inc. 2° CPC, in relation to the legal concept of rules decisoria litis. It aims to demonstrate how the concept indicated in Chilean law has been set. Second, it describes the way in which it has been applied by the jurisprudence of the Supreme Court. And, finally, it presents the dogmatic criticisms that can be made to one thing and another.
