Rol del estado chileno en el sistema de mediación familiar (periodo 2009-2015)

Abstract

The Chilean national family mediation system provides a space for direct and participatory dialogue among poor people with problems in common; as a model of provision of services, by the mediation unit of the Ministry of Justice and Human Rights. The purpose of this article is to analyze the results of the implementation of the family mediation model (2009-2015) in Chile. An exploratory-descriptive study was conducted, with a non-experimental design, analyzing the main variables that make up the process and identifying its essential components. The results reveal that the number of cases filed has grown considerably since its implementation, benefiting more than two million users, have also improved bidding rules, meeting the needs of people. It is concluded that the Chilean State has achieved its objective of fostering a space for direct and participatory dialogue among people of limited resources. In spite of the above, there are challenges such as improving the sustainability of the agreements reached, because there is no permanent monitoring of the agreement to raise the quality of the resolution of conflicts, under the protection of timely justice.
