Abstract

Resumen. El presente artículo busca mostrar las principales características de la tributación de hidrocarburos (particularmente gas natural y petróleo, en la etapa de explotación), evaluando sus enfoques y destacando su especialidad frente a la tributación de la minería metálica. En una primera parte, el articulo expone algunos de los fundamentos sobre los cuales entender dicha tributación, sustentada en los siguientes elementos que aborda. En una segunda parte, muestra los mecanismos fiscales usados por los Estados sobre la explotación de los hidrocarburos, en general. Finalmente, hace referencia a los esquemas de acuerdos o contratos, la estructura de los tributos usados en distintas jurisdicciones, los elementos que se incorporan en la tributación y en las demás herramientas fiscales. Abstract: This paper seeks to show the main characteristics of the taxation of hydrocarbons (gas and oil, especially in the upstream operations), evaluating their approaches and highlighting it particularly in front of the taxation of metal mining. In the first part, the article exposes some of the foundations of the said taxation, based on the following elements that it addresses. In the second part, it shows the fiscal mechanisms used by States on the exploitation of hydrocarbons, in general. Finally, it refers to the schemes of agreements or contracts, the structure of the taxes used in different jurisdictions, the elements that are incorporated into taxation and other tax tools.
