Wittgenstein and the [in]determination of law: the predictability of the normative application from the observations about rules following

Abstract

This thesis has the objective of studying the influence that the wittgensteinian philosophy has on ethical inquiry. The main aspects of Wittgenstein´s most important books will be explained: the Tractatus Lógico-Philosophicus and the Philosophical Investigations. The rigor of logics from the Tractatus influenced Logic Positivism and the ethical No-Cognitivism to believe that ethics will fail an analysis from Formal Logics, so ethics could not be an object of scientific research. Basing their theories on the Philosophical Investigations, various authors have proved that ethics could be studied; we just need to be aware that it has its own rationality. Using Wittgenstein´s observations on rule following from the Philosophical Investigations we are going to try to show how moral rules work and demonstrate that when we apply the wittgensteinian perspective of the normative phenomena, we are able to conclude that a pragmatic and practical reading of the elaboration, learning and application of the ethical rules will allow us to understand that the applicability of morality happens on a intersubjective level.
