Abstract

This article analyzes doctrine and jurisprudence of Article 5.3 of the European Regulation (EC) 44/2001 Brussels I. Specifically, the analysis refers to the concept of “harmful event” on delict or quasi-delict (tort) civil for environmental damage. The rules of jurisdiction must be highly predictable. However, the concept “harmful event” may be a problem of interpretation when there is a relationship between environmental and civil damage. For this reason, it must be analyzed:a) the importance of civil damages, and b) the certainty of environmental damage. These issues justify different linking factor of international jurisdiction.
