Abstract
This article is —from an european perspective— a work about the relationship between the term “weaker party” and the principle favor laesi. The theme also addresses the problem of forum shopping, like the main argument against principle favor laesi in international civil jurisdiction. The doctrine and jurisprudence of the ECJ are convinced. But, what would be their point of view if we’re talking about a victim of environmental damage or a civil direct victim for environmental damage?
