Abstract

This paper analyzes the standards of informed consent of the elderly people in health. Firstly, we study the need for specialization in the protection of elderly people rights. Secondly, the innovation introduced by the Inter-American Convention for the Protection of the Human Rights of Older Persons with respect to informed consent and the development of this right in comparative law and case law. Thirdly, the obligations for Chile established by the Inter-American Court of Human Rights in the Poblete Vilches v. Chile and self-execution of the Convention are examined.
