Abstract

The constitutional recognition of the rights of nature in Ecuador and Bolivia in the last decade as well as the specialization of courts and tribunals in countries such as Costa Rica and Chile have been highlighted as keys to better protect our environment. This chapter aims to depict and analyze the effectiveness of this new paradigm in LATAM and demonstrate how specialization with a wicked institutional design cannot resolve environmental injustice.
