Participaci�n democr�tica y el rol del fiscal como representante de la comunidad pol�tica

Abstract

In this article, I will present the particular moments in which the political community makes its voice heard. First, I will argue that in an ideal democratic political community, prosecutors should always act and speak on behalf of the political community, regardless of how they are elected. Prosecutors must represent the political community during criminal proceedings, particularly in two specific stages: when they decide to call a fellow citizen to account and when they decide not to prosecute someone using different discretion criteria. I will also argue that the political community should also play an important role after the trial. One of the goals of the trial could be for the accused to repent and apologize after thinking and reflecting on the censorship of the political community in which he lives.
