Abstract

Post-contractual liability lacks a comprehensive treatment in our legal system. The purpose of this article is to contribute to the configuration of a post-con-tractual civil liability regime by describing the problems and the main elements that should be considered in order to advance in this task. In its development, the dogmatic method and the recourse to foreign law have been used to ad-dress its most relevant aspects: its temporal delimitation, content and legal na-ture. The main result of this work is to provide the fundamental premises that would allow progress in the construction of a post-contractual liability regime.
