Abstract

The objective of this article is to analyze the scope of supra-individual environmental rights through the Convention on the Rights of the Child, and based on these to explore the legal possibilities available to Children and Adolescents from around the world to present communications individual under the Third Optional Protocol of said Convention. In this way, taking as an exemplary case the Communication of September 23, 2019 (Thunberg and others vs. Argentina, Brazil, France, Germany and Turkey), we will point out -since a descriptive and explicative research, using the dogmatic method, and sub methods systematic, analytic and judgment facts-the perspectives with which the approach to supra-individual environmental rights contained in the Convention is currently being developed, and are unified with the international obligations of due diligence in the face of the dangers derived from climate change.
