Algorithmic discrimination in automated recruitment and hiring processes

Abstract

In this article, we describe and analyse the different forms of discrimination that derive from the design and implementation of automated recruitment and selection processes. In addition, we analyse and assess the substantive, evidentiary and procedural issues that arise when trying to regulate the phenomenon of algorithmic labour discrimination in the pre-contractual stage, with special focus on the challenges that arise for Chilean law.
