Abstract

Gender equality is both a democratic minimum and an international standard of women’s human rights. Although it was not contemplated as a constitutional basis for the Chilean constituent process of 2023, it is possible to identify some contents in the articles of the Draft Political Constitution proposed by the Expert Commission that can contribute to the substantive equality of women. This paper uses two international matrices to contrast the constitutional norms with human rights standards on substantive gender equality, describes the results obtained and proposes articles in those areas in which an omission on the part of the constituent is detected. © 2023, Universidad de Talca.
