Abstract

This research endeavors to ascertain the extension of restrictions governing the employment of foreign individuals, in the context of the Law No. 21,325 and its National Policy on Migration. Employing a meticulous examination of both migratory and labor regulations, complemented by an assessment of their practical implementation, this study reveals that these regulations have not constrained the recruitment of foreign workers. Notably, migratory legislation primarily centers on the approval of visas without consideration of their ramifications on the labor market. Furthermore, the expansive interpretation of exceptions, coupled with diminished enforcement measures, has facilitated the integration of foreign workers into the formal labor sector.
