Abstract

This research article focuses on the study of the Duty of Sacrifice in criminal law, aiming to analyze its significance in the contemporary legal frameworTH and its implications in protecting individuals’ legal rights. Using a methodological approach that involves a comprehensive review of legal principles and theories, the paper presents a reflection on how duties and rights are balanced in conflict situations. Key concepts such as the state of necessity, the differentiating theory, the right to self-defense, and the relationship between freedom and solidarity are examined. The main conclusion of the study underscores the importance of the Duty of Sacrifice in criminal law and its interaction with the concepts of freedom and solidarity, emphasizing the need to consider these principles in constructing a fair and balanced legal system.
