The open access to seawater: an approximation to its legal and economic nature El libre acceso a las aguas del mar: una aproximación a su calificación jurídica y económica

Byrne, Tatiana Celume; Serrano, Juan Luis Goldenberg

Abstract

The administrative and politic difficulties to regulate the use and enjoyment of seawater has led individuals wishing to take advantage of them to submit to a complex extractive regime, which presupposes certain anomalous legal structures that would justify the acquisition of an entitlement. This paper aims for a legal and economic conceptualization of the seawater to account for the regime of its extractive use, from the idea that they are common pool resources admitting their open access.
