Abstract

This article has two aims: first, review the theoretical views and related debates related to "access to justice", in order to propose a concept of right to self-composition of the conflict for consumers. Second, systematize the legal standards that provide the content to this fundamental right of access to justice in private international law and comparative law that can be found in norms and principles that inform the use of Online Dispute Resolution services, ODR, as well as applicable laws. For this, we use the comparative method to analize international instruments that aim to standarize the principles which should govern these platforms in international commerce and, in particular, e-commerce. This study concludes with some recommendations for the integration of these principles in any legal system that considers their adoption.
