Algorithmic management and the labor genome

Abstract

Objective: this work seeks to analyze the effects that automation, robotization and artificial intelligence project on labor law. For this purpose, a particular manifestation of the phenomenon known as algorithmic work management was chosen. The idea expressed in the text is to offer a possible answer to questions about the future of work and, especially, Labor Law. Method: this text presents a qualitative research that preferably used a bibliographic review of the available literature and the current regulations that have emerged on the occasion of this technological advance, which were contrasted with the theory that postulates the existence of elements that would constitute a labor genome and that explain the emergence, configuration and mutations of the discipline. Results: it is observed that there is identity between the components of the work genome as they were originally manifested, and then throughout history, and the effects that algorithmic work management produces on labor relations. Conclusions: algorithmic work management does not alter the existence assumptions of Labor Law. On the contrary, it intensifies the asymmetries between the parties, justifying claims to provide the use of these systems with legitimacy and governanc.
