Abstract

As the legal systems have started to point towards transparency in automated decision-making as a way of protecting the people who may be the subject of said determinations, it has grown the need to analyze how these tools are reconciled with other rights that may be affected by them. This text analyzes business secrecy as a source of opacity, reviewing its operation from the logic of the validity of the principle of good faith in Labor Law, contrasting it with the right to information of the workers’ representatives on the algorithm, takin the spanish Riders Law as example, and looking for evidence that from this perspective, the access to information is allowed as well as the protection of business interests is ensured.
