Built to Suit Contracts for Brazilian Public Institutions: A Case Study of a Performance-Based Approach to Durable, Accessible and Sustainable Facility Occupation

Abstract

In many public institutions across Brazil, there is a recurring need to occupy buildings in multiple municipalities within the same federative state. In the State of Ceara, there are institutions operating in over 100 municipalities, often in ceded, owned, or rented facilities. Occupation of ceded or leased premises has led to significant challenges in building maintenance and insufficient alignment with service needs. Acquiring property comes up against challenges related to acquisition costs and some slowness in the contracting process. In contrast, Built to Suit (BTS) contracts offer a faster, tailor-made construction process that aligns with specific client requirements. This study presents design parameters of a BTS project, incorporating strategies aimed at improving durability, internal layout, and service quality, while reducing maintenance and life cycle costs (LCC) compared to traditional solutions. The adopted solutions are described within the regional context, resulting in a project designed to meet functional, accessibility, and performance standards. Examples include the elimination of gutters over internal spaces-to prevent leaks-and contractual clauses that provide for mandatory preventive maintenance by the lessor. These measures contribute to a design with strong potential to meet the expected performance requirements. As a contribution, it is suggested that the BTS model, combined with a project flow guided by technical-operational diagnosis, can offer a fast and replicable solution for public institutions with high territorial dispersion. The proposed approach supports reducing corrective failures, improves operational performance and contributes to the building's sustainability throughout its life cycle.
